Sebastian County Marriage License Overview
Sebastian County Clerk Offices
The Sebastian County Clerk is Sharon Brooks. The office is the official bookkeeper of county government, issues marriage licenses, records mortgages and deeds, serves as voter registrar, and handles minister credentials. The Northern District office in Fort Smith is at PO Box 1089, Fort Smith, AR 72902-1089, with phone 479-782-5065. Hours run 8 a.m. to 5 p.m. Central, Monday through Friday. The Southern District office in Greenwood sits at PO Box 428, Greenwood, AR 72936, with phone 479-996-4195 for vital records including marriages.
The county also has a Circuit Clerk, Susie Hassett, who supports seven Circuit Judges and handles court filings. The Sebastian County Circuit Clerk is separate from the County Clerk. For a Sebastian County marriage license, you go to the County Clerk, not the Circuit Clerk.
The county's main site lists both offices and the two districts.
The Sebastian County government site makes it easy to pick the right district before a trip, which saves time when the two courthouses are miles apart.
How To Apply for a Sebastian County Marriage License
Both parties must come to one of the clerk's offices together, either in Fort Smith or Greenwood. No appointment is needed. Bring a valid, non-expired, government-issued photo ID. A state driver's license, a state ID card, a passport, a military ID, or an original birth certificate all work. If your photo ID does not show a name change from a prior divorce, bring a certified copy of the decree showing the restored name.
The fee is $60. Applicants 18 or older sign the form, and the clerk hands the license over the same day. There's no wait for adults and no blood test. The Sebastian County marriage license is good for 60 days from the date of issue and works anywhere in Arkansas, not just inside Sebastian County.
Applicants who are 17 need both parents in the room. The parents sign a notarized affidavit of consent under Arkansas Code § 9-11-102. The clerk then holds the license for a 5 business day wait. If the parents are divorced, the custodial parent must bring the latest custody order. No one under 17 may get a license except in narrow court-reviewed cases under § 9-11-103.
What to bring to the Sebastian County Clerk:
- Valid photo ID for each party
- Social Security number for each party
- Divorce decree or late spouse's death certificate for any prior marriage
- $60 for the fee
- Notarized parental affidavit if a party is 17
Note: Either the Fort Smith or Greenwood office can issue a Sebastian County marriage license, and the license is good anywhere in Arkansas for 60 days from the date of issue.
Sebastian County Marriage License Rules
Sebastian County follows the statewide rules in Arkansas Code Title 9, Chapter 11. There's no residency test, so out-of-state couples may come in, pull the license at either district office, and hold the ceremony anywhere in the state. The signed license must be returned to the clerk who issued it inside 60 days, used or not. Failure to return the license can bring a $100 fine.
Who can officiate? Under § 9-11-213, the list covers any judge of a court of record, any former Supreme Court justice, any justice of the peace who served two terms since Amendment 55, the mayor of any city or town, any regularly ordained minister or priest, and any officer picked by the quorum court. Ministers must file their credentials with the Sebastian County Clerk or another county clerk before they can sign a marriage license.
Arkansas does not require witnesses at the wedding. The couple signs, the officiant signs, and the paper heads back to the clerk. A false return by an officiant is a misdemeanor under § 9-11-219.
The County Clerk page explains how the office handles minister credentials and vital records.
That page covers the full scope of the clerk's work, including the voter registrar role and secretary to the Quorum Court and Equalization Board.

Certified Copies of a Sebastian County Marriage License
A certified copy of a Sebastian County marriage license carries the clerk's seal and works for Social Security name changes, passport updates, pension claims, and immigration paperwork. The clerk charges a small fee for a certified copy, commonly around $5 in Arkansas. Call the right district office to confirm the current fee before your visit: 479-782-5065 in Fort Smith or 479-996-4195 in Greenwood.
If a trip isn't in the cards, ask by mail. Send a written request with both parties' names, the date of the marriage if known, your mailing address, and a phone number. Include a check or money order for the fee and a self-addressed stamped envelope. Send the request to the district office that issued the license.
For a state-level copy of the marriage coupon from 1917 forward, order from the Arkansas Department of Health Division of Vital Records. The state fee is $10. The state's online vendor VitalChek also handles orders for an added processing fee. The state coupon is short, so the county copy is the better option when you need the full Sebastian County marriage license paper.
Tip: Ask for two or three certified copies while at the clerk's window. Extras save a second trip when one gets used up.
